Documents required from the employer
What documents and conditions the company must prepare to hire foreign nationals under OUG 32/2026: registration, firm job offer, contracts, organisation chart.

The good news about OUG 32/2026 (Emergency Ordinance no. 32/2026 on the access of foreign nationals to the labour market) is that the physical file of dozens of pages is gone: most checks on the company are performed automatically, by interconnecting the WorkinRomania.gov.ro platform with ANAF, ONRC, the Labour Inspectorate (REGES-ONLINE) and IGI. A few documents and conditions remain that the employer must prepare. We present them in the order in which they arise in the process.
Step 1: registration conditions (art. 5 OUG 32/2026)
Before anything else, check whether the company meets the conditions: no outstanding obligations to the consolidated general budget; at least one year of effective activity in a field compatible with the shortage occupations; no sanctions for undeclared work or for employing foreign nationals residing illegally in the last 6 months; no final convictions of the company, its directors, shareholders or partners for intentional offences; no money-laundering risk. These conditions are not proven with paperwork – the authorities check them through the platform – but if one is not met, registration is rejected.
Step 2: registration documents
- A company account on hub.mai.gov.ro and registration in WorkinRomania.gov.ro (art. 4).
- Self-declarations that the conditions are met, signed with a qualified electronic signature (digital certificate) by the legal representatives (art. 15 para. (2), art. 27 para. (2)).
- Additional electronic documents only if a check cannot be performed directly by the authorities (art. 15 para. (3); art. 10 para. (2) HG 602/2026).
- Translated and legalised criminal record certificate for directors or shareholders who do not hold Romanian citizenship (art. 5 para. (7)).
ANOFM (National Employment Agency) approves or rejects the registration and communicates its decision through the platform within a maximum of 30 working days (art. 5 para. (6) OUG 32/2026).
Step 3: the job vacancy and the firm job offer
The ofertă fermă (firm job offer; art. 6 OUG 32/2026) is the employer's announcement uploaded to the platform. It must contain the job declared vacant to ANOFM (the platform picks up vacancies automatically – art. 12 HG 602/2026) and all the elements under art. 6 para. (1): the duration of the offer, the number of positions, the occupation with its requirements, the duration of employment, working time, gross and net salary with payment dates, allowances, leave, occupational health and safety (SSM) conditions, taxes and contributions, compensation for accidents. Para. (2) requires stating whether the employer provides accommodation (and meals) and transport from the country of origin, domestic transport and repatriation transport.
For D/AM2, the firm job offer is automatically rejected by the platform if the occupation does not appear, with the exact name and COR code, on the Lista ocupațiilor deficitare (List of shortage occupations) (art. 12 para. (3) HG 602/2026). Check the list in force before uploading the offer.
Step 4: contracts for the D/AM2 single application
| Document | Between whom | Model / legal basis |
|---|---|---|
| Service contract | The placement agency and the registered employer; includes the firm job offer | Annex 1 to MMFTSS (Ministry of Labour) Order 655/2026 |
| Contract de plasare (placement contract) | Agency – employer – foreign national (tripartite), in Romanian and in the language of the country of origin | Annex 2 to MMFTSS Order 655/2026 |
| Individual employment contract (CIM) | Employer – foreign national, bilingual, full-time, salary ≥ minimum wage, registered in REGES-ONLINE | Annex 3 to Order 655/2026; art. 27^2 para. (5) OUG 194/2002 |
| Organisation chart | The employer's document, showing filled and vacant positions | art. 27^2 para. (4) letter a) OUG 194/2002 |
| Notarised declaration on accommodation (seasonal workers only) | The employer, before a notary, plus proof of ownership/right of use or a lease | art. 27^2 para. (7) OUG 194/2002 |
Additional documents for the authorised employer
A company wishing to bring in D/AM2 workers without an agency must file, for each firm job offer, an authorisation request (art. 15) with a Treasury account statement or a bank guarantee letter for the guarantee of 1,000 EUR per foreign national, issued no more than 30 days earlier, and electronically signed declarations. The ONRC certificate of good standing is the reference for the condition of at least 50 average employees in the previous year (art. 12 para. (1) letter d)). ANOFM replies within 15 working days at most (art. 16).
Documents for D/AM1 (highly skilled workers)
- The ANOFM certificate on available labour force, issued no more than 90 days before the single application (art. 27^1 para. (4) OUG 194/2002).
- Full-time CIM with a salary at least equal to the average gross salary (9,192 lei in 2026).
- The professional authorisation document, where applicable.
The employee's medical certificate
The Labour Code, art. 27 para. (6)–(7) (introduced by OUG 32/2026), allows the CIM to be concluded with a foreign national without the medical certificate, provided it is obtained before work actually begins. This is a practical adaptation: the contract is signed and registered in REGES before the worker arrives in Romania.
The list above reflects OUG 32/2026, OUG 194/2002 and HG 602/2026 in force on 4 September 2026. The platform may request additional documents case by case; check the specific requirements on the filing date. This article is not legal advice.
