If you hired foreign nationals before 2026, you know the aviz de angajare (work authorisation notice): the document issued by IGI (General Inspectorate for Immigration, the authority that manages immigration) giving the employer the right to hire a specific foreign national for a specific position. This article explains what the notice was, why it disappeared and what you need to do with old files.
What the work authorisation notice was
The notice was governed by Title I of OG 25/2014 (Government Ordinance on the employment and posting of foreign nationals in Romania). The employer filed a physical file with IGI containing: a certificate of good standing from ONRC (National Trade Register Office), a tax clearance certificate, the company's criminal record, the ANOFM (National Employment Agency) certificate on available labour force, proof of publication of the job advertisement and of the selection, financial evidence, plus the foreign national's documents. After obtaining the notice, the foreign national applied for the D/AM long-stay visa at the consulate and, after arrival, for the single permit. The process had two separate stages, with two files.
Why it disappeared
Art. 55 OUG 32/2026 (Emergency Ordinance no. 32/2026 on the access of foreign nationals to the labour market) provides that on the date of entry into force, 27 April 2026, Title I of OG 25/2014 is repealed. The notice is replaced by the cerere unică (single application) in the WorkinRomania.gov.ro platform, and the checks on the employer (debts, activity, sanctions) are performed automatically by interconnecting the platform with ANAF, ONRC, the Labour Inspectorate and IGI.
Old and new, side by side
| Aspect | Old regime (notice, OG 25/2014) | New regime (single application, OUG 32/2026) |
|---|---|---|
| Who files | The employer, with IGI, physical file | The employer (D/AM1) or the agency/authorised employer (D/AM2), online |
| Labour market test | ANOFM certificate + advertisement + selection, for everyone | Only for highly skilled workers (D/AM1); for D/AM2 only a vacancy declared to ANOFM |
| Occupation | Any occupation | D/AM2: only the List of shortage occupations |
| Stages | IGI notice, then visa at the consulate | A single application; the visa follows directly |
| Company documents | Certificate of good standing, tax clearance, criminal record etc. in the file | Checked automatically through the platform; electronically signed self-declarations |
| Agency | Optional | Mandatory for D/AM2 (exception: authorised employer) |
Transitional regime: what happens to old files
- Work authorisation applications filed or scheduled with IGI before 27 April 2026 are processed under the old law (art. 49 para. (1)–(2) OUG 32/2026).
- A visa based on a notice obtained under the old law may be requested within 180 days of the date the notice was obtained (art. 49 para. (3)); these visa applications are processed under the old law (para. (4)).
- Foreign nationals who entered on visas obtained under old notices may request the first extension of their right of residence under the old law (art. 49 para. (6)).
- Work authorisation applications for a change of employer or position could be registered with IGI up to and including 7 August 2026 (art. 50; IGI press release of 14 July 2026).
- From 8 August 2026, foreign nationals with a right of residence obtained under the old law change employer under the new rules in art. 56 para. (9)–(12) OUG 194/2002 (art. 51 OUG 32/2026).
Work authorisation applications under the old regime can no longer be filed. Any new hire or change of employer is now done exclusively through the single application in WorkinRomania.gov.ro.
In August 2026 the business press reported differing interpretations between IGI and MAE (Ministry of Foreign Affairs) regarding unused old notices. This information is not officially confirmed. If you hold a notice obtained before 27 April 2026, check with the consulate, before sending the worker, whether the visa can be granted on its basis.
What it means for your company
The paper file with certificate of good standing, tax clearance and criminal record no longer exists as such. Instead, the company must register in the platform, meet the conditions of art. 5 OUG 32/2026 (no debts, at least one year of compatible activity, no recent sanctions) and, for D/AM2 workers, work through an authorised placement agency. The checks are faster on paper, but the restrictions are stricter: shortage occupations only and no more foreign nationals than the average number of employees in the previous year.
The information reflects OUG 32/2026 and the IGI press releases in force on 4 September 2026. The status of files in transition must be checked case by case, with IGI or the competent consulate, on the filing date. This article is not legal advice.
Frequently asked questions
No. Title I of OG 25/2014 has been repealed since 27 April 2026, and the last notice applications (only for a change of employer) were accepted by IGI until 7 August 2026.
Yes, the visa can be requested within 180 days of obtaining the notice, under the old law (art. 49 para. (3) OUG 32/2026). Confirm with the consulate, however, as practice was inconsistent in August 2026.
The single application in WorkinRomania.gov.ro, filed by the employer (D/AM1) or by the placement agency/authorised employer (D/AM2), which leads directly to the issuance of the visa without an intermediate document from IGI.
Only for highly skilled workers (D/AM1). For D/AM2 workers it is enough for the job to be declared vacant to ANOFM, and the platform picks up these vacancies automatically.
Update of 17 September 2026
Following the decision of the Bucharest Court of Appeal admitting the application, filed by the Employers' Association of Labour Importers (Patronatul Importatorilor de Forță de Muncă) in case no. 5633/2/2026, to suspend the enforcement of Order no. 1073/2026 of the Minister of Labour, Family, Youth and Social Solidarity approving the List of shortage occupations provided for in art. 1 para. (2) of Government Emergency Ordinance no. 32/2026 on the access of foreign nationals to the labour market in Romania, and amending and supplementing certain legal acts (Order no. 1073/2026), the WorkinRomania platform flows for employer registration, employer authorisation and filing the single application for D/AM2 long-stay visas are deactivated.
